When people say their vows, what do they mean? That only the ones
they say to their spouse count, and all the pesky legal stuff at
the beginning is just a formality? If the legal parts don't matter,
then why marry at all, or why not devise your own celebration of
commitment, without involving the law?
The process of legal marriage in Australia includes making sure the
participants understand the law. Prospective married couples in
Australia all come into contact with the following information.
From the
Marriage Act of 1961:
The Family Court is there to preserve and protect the institution of
marriage, to give the family the widest possible protection and
assistance and to protect the rights of children and promote their
welfare. The Family Law Act says:
· Marriage is ‘the union of a man and a woman to the exclusion of all
others voluntarily entered into for life’.
· The family is ‘the natural and fundamental group unit of
society’.
What this imparts is that same sex unions are not 'natural', and are
not recognized as authentic families. The widest possible
protections, including tax benefits, legal and financial benefits,
medical rights, and social acceptance, are provided to legal,
'natural' families, not same sex unions. Without legal sanction,
there is no social equality. Is this really a 'fair go'? Anyone who
married in Australia, married after agreeing they understood these
terms (whether they actually understood them at the time, or not,
whether they thought it was important to speak up, or not.) Anyone
planning to marry will have to agree to these terms before they get
their certificate. Celebrants/marriage officials are required to sign
something saying they made sure the parties were aware of everything
they needed to be aware of.
Apparently a majority of Australians support same sex marriage
equality. Many of these supporters are undoubtedly married. Is it
hypocritical to value a marriage that is at the foundation an
investment in a system that only supports heterosexual unions and
discriminates against homosexuals? Are such married persons in a
sense criminals, perjuring themselves in order to attain benefits? Is
it possible to put things right, to rethink and redefine what
marriage is?
How would it feel to have a marriage declared Null and Void according
to The Law?
What does marriage mean?
Seriously, do we really have to wait until Abbott's term is over
before we can even think about addressing this issue again?
I don't want to get married, but I think every person should have
the right to decide for themselves if they want to get married or
not.
My usual approach is to try to discuss things in a reasonable way. I
wrote the song in about 20 minutes, and today I cut holes in a hat to
make a balaclava. I had been working on 4 other entries that were
taking forever to write, and I thought it might be significant that
this was one was so easy in comparison.. Anyway, it's something new,
something I hadn't tried before, and I think it is in the spirit of
punk.
If I can manage to get a recording/video together, I'll post it. If I
had a band, I'd probably call it
Deranged Vaginas, but I am
guessing it already might be taken by now. In the documentary
Pussy Riot: A Punk Prayer, that term was used, and as well,
the women were called demons and witches.. for having the nerve to
stand up for what they believe in.
